• America’s Job Exchange (AJE) is operated by NaviSite, the company that was previously funded under the federal America’s Job Bank (AJB) grant to develop and maintain the AJB system since 1995.

• AJE was launched by NaviSite in July 2007 as a privately funded, for-profit site in response to the demise of AJB. NaviSite promotes the site as a national labor exchange that provides the functionality of AJB with an updated look and feel.

• AJE is supported by revenue generated in part through on-site advertising; and as of February 2008, through fees charged to employers for the direct posting of job orders. The current fee is $49 per job listing. No fees are currently charged to employers opting to use the AJE batch Public Interface (PI) process of loading a file of multiple job openings into AJE.

• AJE offers states free hosting of State labor exchange sites as affiliate AJE sites. New York State has signed a state participation agreement with NaviSite to host the New York State Job Exchange (NYSJE) at www.americasjobexchange.com/ny. Under this agreement, NaviSite agrees to: (1) host the NYSJE site for free; (2) maintain the NYSJE site free of advertising; and (3) not charge any fees to employers registered with NYSJE for the posting of jobs. Under this agreement, no employer (or jobseeker) should be charged a fee for the use of NYSJE services.
  • NOTE: Given that NaviSite has only recently started to charge employers for posting jobs on the AJE national site, there have been some transition issues identified that are in the process of being corrected. NaviSite has begun implementing changes that will help to distinguish between employers that establish accounts with AJE that may be charged a fee and employers that establish accounts with NYSJE (or other state hosted affiliate sites) that should not be charged a fee.

  • If an employer believes that they are a customer of NYSJE and are being inappropriately charged a fee for posting a job, most likely their account was originally identified as an AJE national account rather than a NYSJE state account. To correct this situation, the employer would need to delete their existing AJE account (assuming there are no open job listings that they want to retain) and re-register as a NYSJE employer. Note that the employer account in AJE/NYSJE uses the employer’s email address as the account identifier. Two accounts cannot be linked to the same email address. For that reason, the employer must first delete the existing account which will free up the email address for use in establishing a new NYSJE account. Alternatively, if the employer wishes to maintain the existing account, they would need to use a different email address to establish a new NYSJE account.

• NaviSite does offer an OFCCP Compliance Solution to Employers. The following language is taken directly from the AJE site (from the OFCCP link on the Home Page) describing this service:

  America's Job Exchange is pleased to provide our OFCCP Compliance Solution. This solution delivers the appropriate information to each of the 50 states in order to help our customers in meeting their Federal Compliance Job Listing obligation. On September 7, 2007, America's Job Exchange began forwarding job postings from companies that have identified themselves as Federal Contractors to the appropriate employment delivery systems in each of the 50 States, in response to the August 8 ruling from the Office of Federal Contract Compliance Programs.

  Data transmission takes place in one of the following ways:

  1. FTP transfer of data file: A number of states subscribe to America's Job Exchange and we regularly prepare files to download for use in their state labor systems. This file includes both Federal Contractor and non-federal contractor jobs.

  2. Email of job listings to designated state level recipient: In cases where a state is allowing for a single email of jobs listing to be sent to a central location, America's Job Exchange sends an email of federal contractor job postings to that location. That location then distributes jobs to the appropriate offices.

  3. Email transfer of job descriptions: For those states that do not have a designated recipient or a subscription agreement with America's Job Exchange, we email the Federal Contractor job listings to the Comprehensive Career One-Stop Offices in the appropriate state based on the location where the job opening occurs.

  We believe that these steps will help federal contractors meet the 41 CFR 60-300 requirements as described in the final rulings announced by the Department of Labor on August 8, 2007. However, given the rulings are relatively new, interpretations of the rulings may change or vary. America's Job Exchange continues to monitor the changes and update the compliance mechanism on an as-needed basis.
